1. Acceptance of Terms
These Terms of Service ("Terms") are a binding agreement between you ("Customer," "you," or "your") and TestPulseQA ("TestPulseQA," "we," "us," or "our"), a business operating under the laws of the State of Georgia, United States. By submitting a form, purchasing a QA Audit, or otherwise using testpulseqa.com or any service offered by TestPulseQA (collectively, the "Services"), you agree to be bound by these Terms. If you do not agree to these Terms, do not use the Services.
You must be at least 18 years of age, or otherwise have the legal authority under applicable law to enter into a binding agreement, to use the Services. If you are using the Services on behalf of a company or other organization, you represent that you have the authority to bind that organization to these Terms.
We may update these Terms from time to time. Material changes will be posted at testpulseqa.com/terms with an updated effective date above. Continued use of the Services after a change is posted constitutes acceptance of the revised Terms.
2. Eligibility
By using the Services, you represent and warrant that:
- You are at least 18 years of age or otherwise have the legal capacity to enter into a binding contract;
- All information you provide to us — including contact information, payment information, and project details — is accurate and complete;
- If you submit a website for a QA Audit or a load/stress check, you own that website or are authorized by its owner to request testing of it;
- Any payment method you provide is one you are authorized to use; and
- Your use of the Services will comply with all applicable laws, and you will not use the Services for any unlawful, fraudulent, or malicious purpose.
3. Services Provided
TestPulseQA offers the following services, each described in more detail on testpulseqa.com:
- Website Quality Assurance (QA) Audits. An automated scan of a customer's website, run immediately after payment, delivered as a PDF and Excel report with screenshots and recommendations that is emailed automatically once the scan finishes.
- Website Developer Referral Service. An introduction service that connects customers seeking a website with independent, vetted web developers in our partner network.
- Website Consultation, where separately offered and agreed to in writing.
- Any other service described on testpulseqa.com at the time you request it.
The specific scope, price, and deliverables of each service are as described on testpulseqa.com at the time of your order, or in any written quote or invoice we provide you. We may add, modify, or discontinue any service at any time; changes will not affect an order you have already paid for.
4. Customer Responsibilities
To receive the Services, you agree to:
- Provide accurate, current, and complete contact and project information, including a valid email address to which we will send your report or referral communications;
- Grant us any access reasonably required to perform the QA Audit (for example, ensuring the submitted website URL(s) are publicly reachable);
- Respond to our requests for clarification or additional information in a timely manner, since delays on your part may delay delivery of your report or referral;
- Use the Services only for lawful purposes and only in connection with websites you own or are authorized to have tested; and
- Not submit a website, or any information, that is fraudulent, infringing, or that you do not have the right to share with us.
5. Payments & Refunds
5.1 — Payment
Payment for a QA Audit is due in full at checkout, processed securely through our payment processor (Stripe or PayPal, depending on which you select). We do not store your card details on our own systems. Current pricing for each service is published on testpulseqa.com and is the price in effect at the time of your order.
5.2 — Refund Policy
A QA Audit is fulfilled by an automated scan that begins immediately after payment and typically finishes within a few minutes. Because of this, our refund policy is as follows:
- Once the automated scan has started. Because the scan begins automatically and immediately upon successful payment, orders are generally non-refundable once payment is complete, since the automated process has already been triggered on your behalf.
- Failed or incomplete scans. If the automated scan fails to complete or does not produce a usable report due to a technical error on our end, you are entitled to a full refund or a re-run of the scan at no additional charge, at our discretion.
- After the included revision. Once the one included revision check described in Section 5.3 has been completed, your QA Audit is considered fully delivered, and the order is not eligible for a refund of any kind, including if you are not satisfied with the outcome of the revision.
- Billing errors. If you were charged an incorrect amount or charged more than once for the same order, we will refund the overcharge in full upon request.
To request a refund, contact us at the email address in Section 16. We aim to respond to refund requests within three (3) business days.
5.3 — Revision Policy
Each QA Audit includes one (1) revision check at no additional charge. After you receive your report and make fixes, reply to your report email within the revision window you selected at checkout (2 or 3 days from purchase/delivery) and we will re-check the items originally flagged as issues. Revision requests made after your selected window, or requests for a second revision, may be offered at our discretion or may require a new QA Audit purchase. Once the included revision check has been completed, the order is closed out and is not eligible for a refund — see Section 5.2.
6. Developer Referral Service
TestPulseQA's developer referral service introduces customers to independent developers in our partner network. In connection with this service, you acknowledge and agree that:
- TestPulseQA is a referral intermediary only. We are not the employer, agent, contractor, joint venturer, or partner of any developer we refer, and no developer is our employee or agent;
- Any agreement for website development work is strictly between you and the developer. TestPulseQA is not a party to that agreement and has no obligation to perform, oversee, or guarantee any development work;
- Even though we vet developers before accepting them into our network, you remain solely responsible for reviewing proposals, pricing, and contracts from a referred developer, and for determining whether that developer is suitable for your project, before engaging them — just as you would with any contractor you found independently;
- TestPulseQA does not guarantee the pricing, timeline, availability, quality, or outcome of any project undertaken with a referred developer, and we are not liable for any dispute, delay, defect, or loss arising from your engagement with a referred developer; and
- TestPulseQA cannot guarantee that a suitable developer will be available for every request. If no developer in our network is a good fit for your project at the time you submit a request, we may be unable to provide a referral.
This service is provided to customers at no charge. TestPulseQA is compensated by developers, not by customers, for successful referrals, as described in our Developer Partner Agreement.
7. Quality Assurance Reports
QA Audit reports reflect the condition of your website as observed by our automated scanning tool at the specific time the scan was performed. Websites change frequently — through your own updates, third-party plugins, hosting changes, or otherwise — and a report is not a continuous guarantee of your website's condition after delivery.
Reports, findings, and fix recommendations are advisory and informational only. They are generated by our automated scanning process based on established QA testing practices, but do not constitute legal, security, accessibility-compliance, or engineering certification, and are not a substitute for professional human review where one is warranted. TestPulseQA does not guarantee that your website is, or will become, free of bugs, vulnerabilities, or errors, whether or not identified in a report, and does not guarantee that implementing our recommendations will resolve any issue or produce any particular business result.
7.1 — Right to Update Reports
A report reflects only the testing we actually performed during your purchased engagement. If you discover a bug or issue after delivery that was not identified in your report — whether because it wasn't present at the time of testing, wasn't within the scope of the audit you purchased, or was introduced by a later change to your website — that issue is not covered by the revision policy described in Section 5.3, and reviewing or updating your report for it is not included at no charge. You're welcome to purchase a new QA Audit for a full re-review, or contact us to ask whether a smaller-scope check is available.
7.2 — Optional Load/Stress Check
If you opt into the optional load/stress check at checkout, you authorize us to send a small, bounded burst of concurrent requests to the URL you provide, for the limited purpose of observing whether your hosting holds up under light traffic. This is not a full load test, and we intentionally keep the burst small and brief to minimize impact.
That said, no test involving concurrent traffic can be guaranteed to have zero effect on a website. Depending on your hosting environment, a resource-limited server could experience a temporary slowdown or a brief error during the check. By requesting this check and confirming the consent checkbox, you accept this risk and confirm you have the authority to request testing of the URL provided, consistent with Section 2. TestPulseQA is not liable for any temporary disruption resulting from a load/stress check you requested, consistent with Section 9.
8. Intellectual Property
Your content. You retain all ownership rights in your website and its content. Nothing in these Terms transfers any ownership interest in your website to TestPulseQA.
Our content. TestPulseQA retains all rights, title, and interest in and to our reports' format and design, testing methodology, templates, business name, logos, and other branding and proprietary materials, unless we agree otherwise with you in writing. Upon full payment, we grant you a non-exclusive, non-transferable license to use and share the substantive findings of your report for your own business purposes (for example, sending it to a developer to have issues fixed). You may not resell, republish, or redistribute our report templates, methodology, or branding.
Marketing Permission
We will not use your website, before-and-after screenshots, QA results, company name, or logo in our marketing materials, case studies, testimonials, or social media without first obtaining your permission. If we'd like to feature your business, we will contact you first, and participation is always optional.
Transactional and Marketing Emails
We may use the contact information you provide to send you transactional emails related to your requested services, including QA reports, developer referrals, invoices, and support communications. With your consent where required by law, we may also send occasional emails about special offers, discounts, new services, and other TestPulseQA updates. You can unsubscribe from promotional emails at any time using the unsubscribe link included in those emails.
Reviews and Testimonials
If you voluntarily submit a review, testimonial, or other feedback about TestPulseQA, you grant us permission to display, reproduce, and publish that review on our website, marketing materials, and social media channels. We may identify you by your first name, company name, or both, unless you request that your review be published anonymously. If you would like us to remove your testimonial in the future, please contact us, and we will make reasonable efforts to do so.
9. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, TESTPULSEQA'S TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICES IS LIMITED TO THE TOTAL AMOUNT YOU PAID TO TESTPULSEQA FOR THE SPECIFIC SERVICE GIVING RISE TO THE CLAIM.
TESTPULSEQA IS NOT LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, LOST BUSINESS, OR LOST DATA, ARISING OUT OF OR RELATED TO THE SERVICES, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
Because the developer referral service connects you with independent developers, this limitation of liability applies with equal force to any claim arising from your engagement with a referred developer, to the fullest extent permitted by law. Some jurisdictions do not allow certain limitations of liability, so some of the above may not apply to you.
10. Indemnification
You agree to defend, indemnify, and hold harmless TestPulseQA and its owners, employees, and agents from any claim, damage, loss, liability, or expense (including reasonable attorneys' fees) arising out of: (a) your breach of these Terms; (b) your submission of a website you were not authorized to have tested; (c) your engagement with, or any dispute involving, a developer referred to you; or (d) your violation of any applicable law.
11. Disclaimer
THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
TestPulseQA does not guarantee that use of the Services will result in increased sales, improved search engine rankings, improved website performance, or any other particular business outcome. Results vary based on factors outside our control, including your industry, your website platform, actions taken (or not taken) by you or your developer after receiving a report, and general market conditions.
12. Privacy
Our collection, use, and handling of your personal information is described in our Privacy Policy, which is incorporated into these Terms by reference.
13. Termination
TestPulseQA may refuse service, decline an order, or terminate access to the Services at our discretion, with or without notice, in cases involving suspected fraud, abuse, non-payment, or violation of these Terms. Sections of these Terms which by their nature should survive termination — including Payments & Refunds (for any amounts already owed), Intellectual Property, Limitation of Liability, Indemnification, Disclaimer, and Governing Law — will survive.
14. Governing Law & Dispute Resolution
Governing law. These Terms are governed by the laws of the State of Georgia, United States, without regard to its conflict-of-law principles.
Informal resolution first. Before filing any claim, you agree to contact us at the email address in Section 16 and attempt in good faith to resolve the dispute informally. We will attempt to respond within fourteen (14) days.
Mediation. If informal resolution is unsuccessful, the parties agree to attempt to resolve the dispute through mediation with a mutually agreed mediator before pursuing arbitration or litigation.
Venue. If a dispute cannot be resolved informally or through mediation, it will be resolved in the state or federal courts located in Georgia, and both parties consent to personal jurisdiction and venue there.
15. General Provisions
15.1 — Entire Agreement. These Terms, together with our Privacy Policy and any order confirmation or invoice we provide, constitute the entire agreement between you and TestPulseQA regarding the Services.
15.2 — Severability. If any provision of these Terms is found unenforceable, the remaining provisions remain in full effect.
15.3 — Waiver. Our failure to enforce any provision is not a waiver of that provision.
15.4 — Assignment. You may not assign these Terms without our written consent. We may assign these Terms in connection with a sale or transfer of our business.
15.5 — Force Majeure. We are not liable for delays caused by events beyond our reasonable control, including natural disasters, internet or hosting outages, and third-party service interruptions (including our payment processor or email provider).
15.6 — Independent Contractor Status. Nothing in these Terms creates a partnership, joint venture, agency, or employment relationship between you, TestPulseQA, or any referred developer.
15.7 — Electronic Communications. You consent to receive communications from us electronically, including by email, and agree that electronic communications satisfy any legal requirement that such communications be in writing.
